These Terms of Tuition set out the basis on which Rohan Lalli provides private tuition to a student and, where applicable, the student's parent or guardian. They are intended to establish a clear, fair and professional framework for booking, payment, attendance, cancellation, academic conduct and the use of tuition materials.

Where the student is under 18, references to the Client mean the parent or guardian who arranges or pays for tuition, unless the context requires otherwise.

1. Definitions and interpretation

1.1 In these Terms:

Client means the person who enters into the tuition agreement with Rohan Lalli and is responsible for payment.

Student means the person receiving tuition.

Lesson means an agreed period of private tuition lasting either 60 minutes or 90 minutes, unless another duration has been expressly agreed in Writing.

Tuition Materials means lesson booklets, notes, worksheets, model answers, marked work, presentations, diagrams, revision resources and other educational materials supplied by Rohan Lalli.

Writing includes email and other written electronic messages used by the parties to arrange tuition.

1.2 Headings are for convenience only and do not affect the interpretation of these Terms.

2. Formation of the tuition agreement

2.1 The complimentary 20 minute introductory meeting is exploratory only. It does not oblige the Client to purchase tuition and does not oblige Rohan Lalli to accept a student for paid tuition.

2.2 A paid Lesson is treated as confirmed once the date, time and applicable fee have been agreed in Writing.

2.3 These Terms form part of the tuition agreement where they have been supplied or brought to the Client's attention before the relevant paid tuition is booked.

2.4 A regular weekly or fortnightly slot may be offered by agreement. Unless expressly agreed otherwise, this does not create a fixed term commitment or a minimum number of Lessons.

3. Tuition services

3.1 Tuition is provided on a one to one basis in either a 60 minute or 90 minute Lesson and is planned with reference to the Student's subject, examination board, current attainment, target grade, recent assessed work and agreed priorities.

3.2 Depending on the Student's needs, tuition may include subject teaching, examination technique, marked written work, targeted homework, bespoke resources, quantitative or source analysis, speaking practice, essay planning, film or literature analysis, NEA guidance and progress communication.

3.3 Rohan Lalli retains professional discretion as to the teaching methods, sequencing of material and resources most appropriate to the Student, while taking reasonable account of the Client's stated objectives.

4. Fees and payment

4.1 The current standard fees are set out below and repeated in Schedule 1.

4.2 Unless another arrangement has been agreed in Writing, payment is due before each paid Lesson. Where several Lessons are invoiced together, the invoice will state the applicable payment date.

4.3 The quoted Lesson fee includes the preparation, resources, agreed homework or marking and progress communication described as included on the website, unless a different arrangement has been expressly agreed.

4.4 The 90 minute Lesson fee is lower than the pro rata cost of 90 minutes calculated from the applicable 60 minute rate. At the current fees, the saving is £8 for a GCSE Lesson and £7 for an A Level Lesson. The applicable extended Lesson fees are set out separately in Schedule 1.

4.5 Any future change to standard tuition fees will be notified in Writing at least 30 days before the new fee takes effect. A revised fee will apply only to future tuition and will not retrospectively alter the price of a Lesson already confirmed and paid for.

5. Cancellation and rescheduling

5.1 The purpose of this clause is to protect time reserved exclusively for the Student and preparation undertaken for that Lesson, while allowing reasonable flexibility.

24 hours or more The Client may cancel or request to rearrange the Lesson without a tuition charge. Any payment made for that Lesson will be refunded or credited, at the Client's choice.
Less than 24 hours A charge of up to 50% of the Lesson fee may apply to reflect preparation already undertaken and the loss of the reserved appointment. The charge will be waived or reduced where the slot is filled by another student or where the resulting loss is lower.
Non attendance without notice Where the Student does not attend and no notice is provided, Rohan Lalli may retain or charge up to the full Lesson fee to the extent reasonably necessary to reflect the resulting loss, including time reserved and preparation undertaken.
Cancellation by Rohan Lalli The Lesson will be rearranged or any payment attributable to that Lesson will be refunded or credited in full.

5.2 Where illness, an emergency or another exceptional circumstance makes attendance unreasonable, Rohan Lalli may waive or reduce any late cancellation charge at his discretion.

5.3 Nothing in this clause permits a cancellation charge that is disproportionate to the loss reasonably arising from the cancellation.

6. Attendance and punctuality

6.1 A paid Lesson lasts either 60 minutes or 90 minutes, according to the duration agreed at the time of booking.

6.2 The Student should join at the agreed start time with the equipment and materials reasonably required for the Lesson.

6.3 If the Student joins late, the Lesson will normally end at the scheduled time so that subsequent appointments are not affected.

6.4 If Rohan Lalli starts a Lesson late, any material teaching time lost will be made up, rearranged or credited.

6.5 If the Student has not joined within 15 minutes of the scheduled start time and no message has been received, the Lesson may be treated as non attendance for the purposes of clause 5.

7. Online tuition and technical issues

7.1 The Student is responsible for having a suitable device, a sufficiently reliable internet connection and access to the agreed video call platform.

7.2 Where a technical problem attributable to Rohan Lalli causes material teaching time to be lost, that time will be made up, rearranged or credited.

7.3 Where a technical problem is attributable to the Student, reasonable attempts will be made to reconnect and continue the Lesson. Where a widespread service outage or another circumstance outside either party's reasonable control makes the Lesson impracticable, the parties will ordinarily seek to rearrange the Lesson without charge.

8. Tuition Materials and intellectual property

8.1 Tuition Materials supplied by Rohan Lalli are provided to the Student for personal educational use.

8.2 The Student may retain, print and use those materials for private study. Unless permission has been given in Writing, the Client and Student must not sell, commercially reproduce, publicly upload, distribute or republish Tuition Materials.

8.3 Homework and written work should be submitted by any deadline agreed during tuition. Work submitted after an agreed deadline may not be marked before the next scheduled Lesson.

9. Academic integrity and assessed work

9.1 Support for Geography NEA, Spanish IRP work, coursework and other assessed work will remain within the rules of the relevant school and examination board.

9.2 Rohan Lalli may teach methodology, analytical methods, subject knowledge, structure, evaluation, referencing and examination technique, but will not write, rewrite or complete assessed work on behalf of the Student.

9.3 The Student remains responsible for ensuring that work submitted to a school, awarding organisation or examination board is authentic and complies with applicable academic integrity requirements.

10. Students under 18 and safeguarding

10.1 Where the Student is under 18, a parent or guardian should remain the principal contact for booking, payment and material changes to the tuition arrangement.

10.2 Direct academic communication with the Student may take place where reasonably necessary for teaching, lesson preparation, homework, feedback or scheduling that has already been agreed with the parent or guardian.

10.3 Students should participate in online Lessons from a suitable environment. Rohan Lalli may suspend or end a Lesson where conduct, communication or circumstances are inappropriate or raise a safeguarding concern.

11. Recording, confidentiality and communication

11.1 Neither party may make an audio or video recording of a Lesson without the prior agreement of the other party and, where the Student is under 18, the parent or guardian.

11.2 Personal information, Student work and tuition correspondence will be used only for legitimate educational and administrative purposes, subject to the separate privacy information applicable to the service.

12. Standard of service and educational outcomes

12.1 Rohan Lalli will provide tuition with reasonable care and skill and will take reasonable steps to adapt teaching to the Student's agreed needs, examination board and progress.

12.2 Examination grades, university offers and other educational outcomes cannot be guaranteed. Outcomes depend on factors outside the tutor's control, including attendance, independent study, school teaching, examination conditions and the Student's own performance.

12.3 Any grade improvement figures, testimonials or university destinations published on the website describe previous students or historical outcomes and do not constitute a promise that another Student will achieve the same result.

12.4 Nothing in these Terms excludes or restricts any statutory right that cannot lawfully be excluded or restricted.

13. Termination of ongoing tuition

13.1 Unless otherwise agreed in Writing, there is no minimum number of paid Lessons.

13.2 The Client may end ongoing tuition at any time. The cancellation provisions in clause 5 continue to apply to any individual Lesson already confirmed.

13.3 Rohan Lalli may end ongoing tuition on reasonable notice. Tuition may be ended immediately where there are serious grounds, including abusive conduct, repeated non payment, deliberate academic dishonesty or a safeguarding concern.

13.4 Any payment for future tuition that will not be provided will be refunded, save for any amount properly due in respect of a service already supplied or a fair cancellation charge arising under clause 5.

14. Statutory consumer cancellation rights

14.1 Where the tuition agreement is a distance contract within the meaning of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Client may have a statutory right to cancel the contract within 14 days beginning on the day after the contract is entered into.

14.2 Where the Client asks for paid tuition to begin during that statutory cancellation period, Rohan Lalli may ask the Client to make that request expressly in Writing before the first Lesson begins.

14.3 If the Client validly exercises a statutory right to cancel after tuition has begun at the Client's express request, the Client may be required to pay a proportionate amount for services already supplied, as permitted by law.

14.4 Where the service has been fully performed during the statutory cancellation period following the Client's express request and acknowledgement, the right to cancel may cease once full performance has taken place, where the applicable law permits.

14.5 The Client does not have to use a particular form of words to exercise a statutory cancellation right, provided the decision to cancel is communicated clearly. A model form appears below for convenience.

15. Complaints

15.1 A concern relating to tuition should be raised as soon as reasonably practicable using the email address through which tuition is arranged.

15.2 Rohan Lalli will consider the concern in good faith and will ordinarily aim to provide a substantive response within five working days.

16. General provisions

16.1 Entire agreement. These Terms, together with the written booking details and any individually agreed written variation, constitute the basis of the tuition agreement. An individually agreed term will take precedence over these general Terms only to the extent of the inconsistency and only where it is lawful and clear.

16.2 Variation. No variation to a confirmed booking is effective unless agreed in Writing. Rohan Lalli may revise these general Terms for future bookings, but a revision will not retrospectively alter a Lesson already contracted on earlier terms.

16.3 Severability. If any provision is found to be unlawful or unenforceable, the remaining provisions will continue in effect so far as the law permits.

16.4 No waiver. A decision not to enforce a provision on one occasion does not prevent that provision from being relied upon on another occasion.

16.5 Third party rights. Except where the Student is not the Client and a provision is expressly intended to benefit the Student, no person who is not a party to the tuition agreement has any right to enforce these Terms.

16.6 Governing law. These Terms are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory rights a consumer may have to bring proceedings in another jurisdiction.
